Our affiliate terms and conditions

Mr-Hanf.de offers you the opportunity to participate in an affiliate program with which you can earn advertising revenue (sales commission) for advertising successfully presented on your website for Mr-Hanf.de. If you are interested in the partner program, please read the following partner agreement carefully and click on "Register now" at the bottom of the page. By doing so, you accept our partner agreement. You will then be taken to the registration form for the Mr. Hanf.de affiliate program.

The basic requirements for participation in the Mr. Hanf.de partner program are that you are at least 18 years old, have full legal capacity and operate a website.

The subject of this contract is the commercial placement of electronic advertisements on the partner's website by Mr. Hanf.de. The subject matter of the contract is the products that can be purchased at Mr. Hanf.de. The following agreement contains the conditions for participation in the partner program of Mr. Hanf.de and the establishment of links from a partner website to our website (https://Mr-Hanf.de). The following conditions apply. You can download the text to your computer and/or print it out. We do not recognize any provisions deviating from these terms and conditions unless they are confirmed by us in writing.

If you agree to participate in the partner program of Mr. Hanf.de by concluding the following partner agreement, Mr. Hanf.de will pay you advertising income if a sale can be proven to have been made on the basis of the advertising for Mr. Hanf.de presented on your website.

It is hereby expressly clarified that in the following use of the term "partner" or "partner agreement" it is not intended or intended by the parties that the cooperation is one that falls under the Partnership Act.

I. Registration

1. by submitting a fully completed application, you register for the partner program. Activation takes place immediately. You will receive an e-mail confirming receipt of your registration. Mr. Hanf.de will then review your application and, in the event of a rejection, inform you as soon as possible. If you do not receive a rejection within 7 working days, your application is deemed to have been accepted. By submitting your application, you guarantee that you will carry out the advertising activity for Mr. Hanf.de and that you agree to the following conditions of participation.

2. mr-Hanf.de reserves the right to reject applications if you do not participate in the partner program or if we are of the opinion that your website is not suitable for the partner network of Mr. Hanf.de due to its content. In particular, we will reject from the outset websites with content that glorifies violence, content that is harmful to minors and content that violates Austrian law.

II Structure and maintenance of the partner website

1. after Mr-Hanf.de has received a fully completed application form, Mr-Hanf.de will provide the applicant with a partner identification number (program ID) and instructions on how to connect to Mr-Hanf.de, which will enable accurate tracking of advertising revenue. Upon receipt of the partner identification number, the applicant becomes a partner of Mr. Hanf.de within the framework of the partner program, subject to the verification by Mr. Hanf.de mentioned under point I.

2. we will provide you with a selection of graphic links (hereinafter "links") for your partner website via the partner information area, with which you can create links to Mr. Hanf.de. You can include these links in any number and in any area of your website. The Links serve to identify your website in the Mr. Hanf.de partner network and establish the connection from your website to our website. The links can refer to different areas of our website. The correct technical integration is the responsibility of the partner.

3. mr-Hanf.de assigns you a partner identification number (program ID) and transmits it to you. This identification number, together with the password you chose when registering, gives you access to a protected member area. From this member area you have access to the status of your partner account and can view your sales statistics.

4. mr-hanf.de assumes full responsibility for the fulfillment of any customer orders placed by a user identified as coming from an affiliate website and all related customer services.

5. the maintenance of the Partner Website is the responsibility of the Partner. As long as the Partner uses the Mr-Hanf.de links, the Partner undertakes to regularly update the information and links in connection with Mr. Hanf.de products.

III Calculation of your advertising revenue

1. you will receive remuneration for advertising from Mr. Hanf.de successfully presented on your website, which has led to customer revenue for Mr. Hanf.de. This remuneration consists of 15% of our income from product sales to customers who have reached our website through your links.

For the calculation of the remuneration, only our revenue from sales of Mr. Hanf.de products counts if the customer has selected our website via a link on your website immediately before the purchase and the sale, delivery and full payment of the goods have been completed. Advertising revenue is only calculated based on the product prices listed on the Mr. Hanf.de website. Additional costs charged to the customer (e.g. applicable taxes, cash on delivery, shipping or freight costs, etc.) are not included in the calculation of revenue. Likewise, vouchers issued by Mr. Hanf.de do not count towards the calculation of revenue.

2. if a refund of the purchase price is made to the customer, the amount is also deducted when calculating the remuneration for the partner. If a customer receives a refund of the purchase price after advertising revenue has already been paid out to the partner for this, Mr. Hanf.de is entitled to deduct this revenue from the partner again in the next calculation period.

3. please note that sales to customers who have not accessed our website via a link on your website immediately before placing an order are not included if they have already accessed or purchased from us via your website at an earlier point in time.

IV. Payment of advertising revenue

1. the payment of your advertising revenue is billed quarterly for the previous months and is due in the following month after billing. The preferred method of payment is by bank transfer to the partner's bank account. The relevant fields in the registration form must be completed for this purpose.

2 Mr. Hanf.de reserves the right to include advertising revenue that does not exceed EUR 50 in the next calculation period. In the event of termination of the partner agreement, the advertising income will be paid out irrespective of this EUR 50 limit.

3. if Mr. Hanf.de is legally obliged to pay taxes on your remuneration, these will also be deducted accordingly from your remuneration. If you are liable for VAT, please state your VAT number. If you do not provide a VAT identification number, you expressly declare that you are not liable to pay VAT. We will then transfer the advertising revenue without VAT. If you become liable for VAT during the contractual relationship, please inform us immediately. Mr. Hanf.de has the right to reclaim any additional claims from the tax office resulting from incorrect information about your VAT liability. If necessary, you must also prove your VAT liability with an extract from the commercial register or a business registration.

4. mr-Hanf.de reserves the right to refuse payment in case of suspicion of a fraudulent transaction in the current or a previous calculation period.

5. a claim for reimbursement of expenses and costs in connection with your advertising activity is excluded.

V. Obligations of the Partner

1. you are fully responsible for the establishment, operation and maintenance of your website and for all materials that appear on your website. This responsibility relates in particular to the technical operation of your site and the necessary technical systems.

2. you undertake to ensure the accuracy and correctness of the materials displayed on your website (in particular the display of all product-related materials from Mr. Hanf.de) and to ensure that the material on your site does not infringe the rights of third parties or is not used in any way for illegal, fraudulent or defamatory purposes or activities.

3. you agree that the Mr-Hanf.de logo, graphics or text will not be modified in any way and that the graphics available in the affiliate program area will be used only for their intended purpose, i.e. to create and display a link to Mr-Hanf.de. The partner identification number and password may not be disclosed to third parties. You further agree not to disclose any information relating to sales or advertising revenue generated through the affiliate program without the permission of Mr. Hanf.de.

4. you agree not to set up your website in such a way as to create confusion with the Mr. Hanf.de website or to give the impression that your website belongs to or is part of our website.

5. you agree not to use any materials from Mr. Hanf.de on your website unless you have our explicit permission to do so or you can find permission to do so directly on our website. Your domain name and the metatext of your website must not contain the words, "Mr. Hanf". Furthermore, you agree not to register with any search service on the Internet under this keyword. You agree not to distribute, directly or indirectly, any other advertising material relating to Mr. Hanf.de without submitting such material to us and obtaining our written consent to do so. Such consent will not be unreasonably withheld by Mr. Hanf.

6. you are not authorized to make or accept offers on behalf of Mr-Hanf.co.uk or to represent Mr-Hanf.co.uk. You will not make any statements to third parties that give the impression that you are authorized to represent Mr-Hanf.de.

7. you are obliged to indemnify Mr. Hanf.de against any claims by third parties and costs in connection with the defense against claims by third parties in connection with the setup, operation or maintenance for which you are responsible and the content of your site.

VI Licenses

1. you are granted a non-exclusive, non-transferable license, revocable at any time, to access our website via agreed links and, solely in connection with such links, the right to use the Mr. Hanf.de logo and other materials provided on our website for the purpose of promoting our website. This right is for the sole purpose of creating links between your website and the Mr. Hanf.de website that enable your users to purchase Mr. Hanf.de products. You may not revise, amend or change the licensed materials in any way.

2. it is expressly clarified that this contract does not affect any intellectual property rights held by Mr. Hanf.de at the time of this contract. Nor shall it affect any additional intellectual property rights that may result from improvements, modifications or changes made by Mr. Hanf.de in the future. The partner recognizes the right and ownership of Mr. Hanf.de at the time of the conclusion of this contract and beyond. He also expressly agrees that no action may be taken or omitted in any way that threatens or endangers the intellectual property rights of Mr. Hanf.de.

It is also expressly clarified that future uses or licenses of Mr-Hanf.de and the underlying technology of Mr-Hanf.de with third parties are not restricted by this contract. The provision of graphics by Naturprodukte Scherzer to the partner is exclusively a limited license in connection with the connection to the Mr. Hanf.de website.

VII Contract term and termination of contract

1. the contract period of this agreement begins with the acceptance of the partner's application by Mr. Hanf.de and ends with the termination by one of the two parties. Both parties can terminate the agreement at any time with a notice period of seven days without any special reasons. Notice of termination must be given in writing. The date of receipt by the recipient of the notice of termination shall be decisive. After the termination becomes effective, the partner is only entitled to receive advertising revenue relating to sales during the term of the agreement.

2. mr-Hanf.de has the right to terminate this contract with immediate effect in the event of breaches of contract by the Partner, in particular in the event of breaches of the Partner's obligations under point V. from clauses 5 and 6, and in particular if:

* The Partner's website contains illegal, fraudulent or defamatory content or is used for such purposes and activities
* Mr. Hanf.de is of the opinion that the continuation of this contract is not in its interest
* The Partner breaches any provision of this Agreement that cannot be remedied; or
* The Partner fails to rectify any breach of this Agreement that can be rectified within seven days of Mr-Hanf.co.uk notifying the Partner and requesting rectification.

3. mr-Hanf.de reserves the right to withhold the compensation due after the last relevant billing period prior to termination for a period of three months to ensure payment of the correct amount.

4. compensation and settlement claims are excluded.

5. upon termination of this agreement, all rights of use granted to the partner under this agreement to the advertisements, messages and other representations provided by Mr. Hanf.de shall expire. The Partner must take all technical precautions to ensure that no links between its website and the Mr. Hanf.de website exist after the termination of this agreement.

VIII. Warranty and liability

1. mr-hanf.de endeavors to operate its website within the scope of its technical possibilities and to ensure the uninterrupted operation of the Mr. Hanf.de website. Mr-Hanf.de gives no assurances with regard to the partner network, the Mr-Hanf.de products or that the Mr-Hanf.de website will be error-free or available at all times.

2. mr-hanf.de accepts no liability to the Partner or any other person for any costs, losses or liabilities (including loss of profit or other damages or consequential damages) arising from the Partner's failure or delay in fulfilling its contractual obligations. Liability is also excluded if the Partner fails to comply with the content, context or confidentiality of communications relating to the Mr. Hanf.de website. This exclusion of liability only applies insofar as it is legally permissible and possible. Legal liability that cannot be excluded by contract is not affected by this. In these cases, Mr-Hanf.de is only liable for damages caused by gross negligence or willful misconduct on the part of Mr-Hanf.de or its vicarious agents.

IX. Confidentiality

1. the partner expressly undertakes to refrain from disclosing the partner identification number and password provided to him by Mr. Hanf.de to third parties. Furthermore, the Partner is prohibited from disclosing any information relating to sales revenue generated through participation in the Partner Program, unless Mr. Hanf.de gives its express written consent to such disclosure by the Partner. The obligations contained in this provision shall continue to apply in full even after termination of the contract.

2. furthermore, the partner undertakes to treat all other information, in particular the provisions of this agreement, business and financial information, customer names and addresses as well as sales lists and price and sales information as strictly confidential. This information and data may not be used by the Partner either directly or indirectly for its own commercial purposes or for other purposes. Anything else shall only apply if Mr. Hanf.de has given its written consent.

X. Amendments to the contract

Mr. Hanf.de reserves the right to amend this contract at any time. You will be informed of the changes by e-mail. These will also be made available in the partner information area. Adjustments or changes may relate in particular to those relating to remuneration or the payment procedure. If a contractual amendment made by Mr. Hanf.de is not acceptable to you, you are entitled to terminate the agreement. Your continued participation in the partner network after notification and commencement of the period of validity of the amendment shall be deemed to be acceptance of the amendment.

XI. Completeness of the contract/additional agreements

This contract constitutes a complete contract between the contracting parties with regard to the subject matter of the contract. All communications and prior agreements relating to the subject matter of this Agreement are superseded by this Agreement.

This Agreement is not assignable without the written consent of Mr. Hanf.de.

XII. Applicable law/jurisdiction

The agreement shall be governed exclusively by Austrian law. The court responsible for Innsbruck is agreed as the exclusive place of jurisdiction. Mr. Hanf.de reserves the right to also sue at the partner's place of jurisdiction.

XIII Severability clause

Should individual provisions of this contract be or become wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions of the agreement. The same applies in the event that the agreement contains a loophole. In place of the invalid or unenforceable provision or to fill the gap, a legally valid provision shall apply which comes closest to the content and purpose of the invalid or unenforceable provision.

XIV Contractual commitment

By submitting your registration, you declare that you have read and understood the contractual terms and conditions and that you undertake to be contractually bound by these terms and conditions.
